A failure of the System

Recently, I read about a Pennsylvania resident who was caught by the authorities when he/she bought wine and spirits in Delaware.  I do not know all the details but the pure fact that the person was caught belies the reality that Pennsylvania residents do travel to the state of Delaware to purchase wine and liquor at cheaper prices.

This practice by Pennsylvanian’s residents  is accentuated by the fact that on a weekly/monthly basis, I and others who live in Pennsylvania receive brochures with sales and/or other incentives from the state of Delaware liquor establishments  (Total Wine in particular) to purchase wine and liquor at their stores.   This advertisement is done on the open market regularly without any kind of infringement of the authorities in Delaware or in Pennsylvania.

So the question that I have for these state and local agents who try to trap Pennsylvania’s residents who are lured to Delaware on a weekly basis to buy cheap wine out of state is just one.   Instead of punishing residents with fines etc. for purchasing according to them illegal wine and spirits, why not prevent Total Wine and other Delaware liquor companies from enticing out-of-state people to buy wine in their state?

Why punish the people when businesses are conducting illegal activity by soliciting out of state buyers?  It is insane and unfair to punish the little people who want to save a dollar or two when the big fats in business who rake hundreds of dollars selling wine etc. to out-of-state purchasers.

Stop the advertising of these unscrupulous businesses who know that it is illegal to sell wine to out-of-state people instead of doing nothing to businesses while punishing a person for buying a bottle of wine.  When someone buys wine with a credit card with an out-of-state address, Total Wine in particular should stop that sale.  Are not these sellers as guilty as the buyers?   Enforce the law of illegal advertising and solve all the problems.  The system should help the people not punish them when the system fails in their own responsibility.

Prevent Delaware liquor stores from doing out-of-state advertising to entice Pennsylvania residents from purchasing wine and spirits in Delaware.
