Marijuana Blunt Found in Suspicious Chimney Cleaning Van

Police cited a man driving around a van in Newtown Square for failing to have a registered driver's license and the discovery of a marijuana blunt inside the van.

NEWTOWN SQUARE–On Jan. 23 at approximately 1:40 p.m., Newtown police received information from an off-duty officer who reported a suspicious van driving around the upper Saint Albans neighborhood in Newtown Square.

According to the report, the off-duty officer had arrested a person who was operating a van with All American Chimney on the side of the van approximately a year ago. The van that the off-duty officer observed on Jan. 23 had the same All American Chimney sign on the van, according to the report.

Police were able to locate the van in the parking lot of the Newtown Square Wawa on North Newtown Street Road and had a New York registration plate. Police approached the man sitting in the passenger’s side of the vehicle, who showed police a New York driver’s license. At this time, according to the report, police observed what appeared to be a marijuana blunt in the cup holder.

The man informed the officer that the driver of the vehicle was inside Wawa getting food. When the driver came out of the Wawa, police approached the driver, who also showed police a New York driver’s license. According to the report, both driver’s licenses checks came back negative and the driver’s driver's license was revoked.

The driver then denied driving the van, according to police. When police told the man that he was seen by an off-duty officer driving the van, the man then admitted to driving the van and accepted ownership of the marijuana blunt in the cup holder.

The man was cited for driving without a registered license and a non-traffic citation for the marijuana blunt.

Shouldn't this story be titled "suspicious chimney cleaning van". Nobody cares about the marijuana blunt. Why don't you check out what some other states are doing. Or even this article: http://haverford.patch.com/articles/marijuana-should-be-legalized-local-legislator-says

Marijuana legalization and regulation is finally getting the attention it deserves. Senator Daylin Leach has announced plans to introduce legislation that would legalize marijuana in Pennsylvania.

Totally agree, Melissa. The fact the MJ is still a DEA schedule 1 drug is preposterous. It has been shown to have medical benefit, and is much safer than the alternative recreational drug- alcohol. Perhaps with Washington and Colorado acting as grown ups on this issue we'll put an end to the ridiculous incarceration of otherwise law abiding citizens. But big pharma, industrial prison making and the alcohol industry see this as threat to their bottom lines.

Forget the mention of MJ, the REAL outrage is that just because the off duty cop saw a van belonging to someone he arrested a year before was NO reason to walk up and ask for proof of this and that. Is that van gonna be stopped evry time a cop sees it now?

I agree. Police need reasonable suspicion to detain you. Seeing a "van with a logo" does not qualify. They also have no right to demand ID unless driving a vehicle (which neither man was at the time).
If this is how police work is going to be conducted, we'll need to start carrying lawyers around in our back pockets to educate the cops

I'm not going to pretend like I know the whole story, this article only touches the surface of what happened, and what had happened a year ago. I googled All American Chimney, NY and came across dozens of companies, a lot of which, if not all, were local businesses for towns in New York, which makes it's presence in southern PA exotic, in the very least. And for all we know, the arrest from a year ago could have been some serious business, perhaps relating to a drug trafficking. I think it's unfair for anyone to assume that these cops were in the wrong with such little information.
