Traffic Stop Leads To Marijuana Arrest

A 27-year-old Upper Darby man told police he had smoked marijuana just prior to driving.

NEWTOWN SQUARE–On Feb. 9 at approximately 10:10 p.m., Newtown police was facing east in the right lane of West Chester Pike/Rt. 3 at the intersection of Bryn Mawr Avenue behind a tan Buick.

According to the report, the vehicle’s registration plate displayed a January 2013 registration, which police confirmed that the registration was indeed expired. Police activated their emergency lights for a traffic stop, and were able to stop the vehicle at the intersection of Rt. 3 and Barren Road.

Police approached the passenger’s side of the vehicle and spoke with the driver, who was the only occupant in the vehicle, according to the report. Upon speaking with the driver, identified as a 27-year-old from Upper Darby, police detected a strong odor of marijuana coming from the man and observed the man’s eyes were glassy, according to the report.

Police told the man he could smell the burnt marijuana and asked the man if there were any weapons or drugs in the vehicle. The man told police there were no weapons or drugs in the vehicle and informed police he had smoked marijuana prior to driving, hence the odor coming from him, according to the report.

Police placed the man under arrest for suspicion of driving under the influence of a controlled substance. While conducting a search on the man, police located a clear sandwich-sized bag in his right jacket pocket.

According to the report, the bag contained a green leafy vegetable matter suspected to be marijuana. In addition, police found a device inside the man’s hooded sweatshirt, commonly used to grind marijuana.

The man faces charges of DUI; prohibited acts/penalties; registration and certification of title required; and prohibited acts/penalties—possession with intent to use drug paraphernalia.
